Benzene Exposure

"Efficiency and economy imply employment of the right instrument and material as well as their right use in the right manner."
United State Supreme Court Justice Louis Dembitz Brandeis

St. Louis & Ohio Rail v. US

The Quiet Killer

Benzene is a carcinogen. It has been shown to cause leukemia and other types of cancer.

It's everywhere. Many companies in the United States use benzene to make other chemicals that are key elements of plastics, resins and nylons and synthetic fibers. It is primarily used as a solvent in the chemical and pharmaceutical industries and to degrease metals. Since 1959, the greatest US source of benzene has been petroleum.

According to the CDC, benzene ranks in the top 20 chemicals for production volume and exposure to benzene can occur on many levels. It can be found in the air at low levels in tobacco smoke, gas station fumes, car exhaust and industrial emissions. Air at hazardous waste sites can contain relatively higher concentrations than other areas. Indoor air can contain benzene in higher concentrations than outdoor – the benzene indoors can come from flues, paints, furniture wax and detergents. Benzene leaks from underground storage tanks can leak into groundwater.

Life After Exposure
The general public is in danger of benzene exposure through contaminated air, mostly from cigarette smoking, from contaminated water and contaminated food. People who work for companies or in factories that make products using benzene are at a greater risk for exposure – and leukemia.

Surviving cancer depends on attacking it early and attacking it fiercely. If you suspect that you or a loved one have been exposed to benzene at work at levels that result or are likely to result in health problems, you must seek legal counsel immediately in order to protect your long-term financial and medical outlook.

Your attorney should immediately address your medical needs by referring you to an experienced physician in the field – and then address your legal needs based on your medical assessment.

The Law
Bringing a lawsuit for benzene exposure is based in negligence. The statute of limitations, which is the amount of time you have to file a lawsuit for the wrong, is two years from the date that you realize there has been exposure at dangerous levels because of a negative diagnosis.
