Workplace, Workman's Comp, Third Party Claims

“Value has been defined as the ability to command the price.”
United States Supreme Court Justice Louis Dembitz Brandeis
St. Louis & Ohio RR v. US

Hurt on the Job
You work for years in construction to support your family only to fall from a scaffold and break your leg. You fear that you will be fired and unable to earn a living because construction is all you know and your leg is going to keep you from working for many weeks or months.

Perhaps you work for years in a secretarial position but become sick one day. You stay sick for some time, and it appears that you cannot “shake” whatever ails you. You may use up your entire reserve of sick days because of it. In fact, there are several people in the office with the same symptoms. The office finally makes an announcement that they have discovered a terrible mold problem in the air vents of the office, and that the office will be closed until the problem is repaired. You get well after some time away from the office so it is clear the sickness was a result of the mold problem at the office.

When you’re hurt while working or become sick because of your job, your main objective is to get well so that you are able to work long-term. The second concern is how to pay for everything and receive compensation for missed work.

If you or a loved one was injured on the job or sick because of work, you must seek representation from an experienced lawyer to assist you in filing a claim for worker’s compensation or a lawsuit to seek compensation for any damages.

The Law
Texas has a state-regulated insurance program (worker’s compensation program) that pays medical bills and replaces a portion of lost wages if you are injured on the job or have a work-related illness.

The Texas workers' compensation statutes are located in Texas Labor Code, Title 5. Workers' Compensation

Money Damages
If your employer takes part in the insurance program, worker’s compensation will cover your medical bills if you were injured at work or became sick because of work. If your employer takes part in the program and you lose all or part of your income for more than seven days then worker’s compensation will replace a portion of your lost wages.

If your employer does not provide worker’s compensation or you are not able to be awarded the proper money in payment for your medical bills or lost income, an attorney may be needed to advocate for you in dealing with the State or file a lawsuit in order for you to adequately protect your rights and seek just compensation.
