Motor Vehicle accidents

"Litigation is the pursuit of practical ends, not a game of chess."
Supreme Court Justice Felix Frankfurter

Indianapolis v. Chase Nation Bank

Yes, It Happens

Motor vehicle accidents occur when we least expect them - and usually when we can least afford them. Cars, trucks, and motorcycles are so much a part of our daily lives that accidents are inevitable for a great many of us. Unfortunately, in our country more than 40,000 people are killed each year, and over 2.5 million are injured from nearly six million crashes.

Costs from this type of injury or loss can be devastating. In 2000, the latest reporting year for the National Highway Traffic Safety Administration, medical costs were over $32,000,000,000 nationwide or $820 per person in the United States.

Injuries can take many forms, but generally range from soft-tissue, whiplash-type injuries to vertebral/spinal injuries to brain trauma to knee and shoulder injuries to broken bones. Medical attention for motor vehicle accident injuries can be costly but is often covered by insurance.

Financial problems can sometimes surface long after the injury date and after the settlement money has been paid, however. For example, a large percentage of auto accident injuries result in an injury called whiplash, which does not always immediately generate symptoms. Quite often, pain and medical treatment will occur long after all settlements have been reached.

It Happened to You - Now What?
If you were involved and/or injured in a motor vehicle accident, hopefully you started the process by protecting yourself by not claiming any fault and by not accepting any offers of settlement. Next, you must find a good lawyer immediately who will protect your interests. Finding someone who knows how to handle insurance companies and their lawyers, and what to address medically and legally will not only protect you from losing some potentially serious money, but it may protect you from long-term or latent health problems.

Since insurance companies are watching out for their bottom line, you need someone to watch out for yours.

The Law
Car accident cases are one of the most common personal injury lawsuits. The cause of action is usually one based in negligence, and the statute of limitations for suing someone in Texas for an accident is two years. Usually there is an insurance company to work with, either yours or theirs.

Money Damages
Financial recovery can include vehicular/personal property damage and present and future medical bills. Other potential areas of compensation, depending on the facts of the situation, are mental pain and suffering damages, lost past and future wages, permanent impairment/disfigurement, punitive damages, wrongful death damages and loss of enjoyment of life.

Whether or not you have the right lawyer on your side can dramatically affect your financial and medical status after a wreck.
