| "Progress flows only from struggle." Supreme Court Justice Louis D. Brandeis Business--A Profession Just Not Worth It Getting and staying slim is a popular pursuit in American culture. Most people seem to be searching for the perfect elixir in their quest for physical excellence. But sometimes, people go to extremes in that quest. Many companies sell their drugs or supplements prematurely to an anxiously awaiting public without proper testing and/or warnings of potentially adverse side effects. Iovate Health Sciences Inc. and Muscle Tech Research and Development, Inc., the makers of the popular weight-loss supplement Hydroxycut, have done just that. The Newest Warning The U.S. Food and Drug Administration issued a warning to the public as recently as May 1, 2009.1 This warning states that: The U.S. Food and Drug Administration is warning consumers to immediately stop using Hydroxycut products by Iovate Health Sciences Inc., of Oakville, Ontario and distributed by Iovate Health Sciences USA Inc. of Blasdell, N.Y. Some Hydroxycut products are associated with a number of serious liver injuries. Iovate has agreed to recall Hydroxycut products from the market. Also, in 2003, the Missouri Attorney General sued Muscle Tech Research and Development, Inc. for not disclosing safety risks associated with Hydroxycut containing ephedra, and claims that Hydroxycut was "clinically proven" to be a "fat-burner" were false.2 The maker paid $100,000 in settlement with the State.3 The FDA has received 23 reports of serious health problems ranging from jaundice and elevated liver enzymes, an indicator of potential liver injury, to liver damage requiring liver transplant. One death due to liver failure has been reported to the FDA. Other health problems reported include seizures; cardiovascular disorders; and rhabdomyolysis, a type of muscle damage that can lead to other serious health problems such as kidney failure. No matter the source, Hydroxycut is bad news. In an attempt at looking better, we make our health worse by taking this weigh-loss supplement. It is just not worth it. If you or a loved one has been injured by taking Hydroxycut, it is crucial that you obtain competent and experienced legal representation in order to seek redress and financial compensation for the injuries. These companies and others like them must be sent a strong message that your health is more important than their bottom line. Chad Pinkerton is a proven contender against large corporations making false claims. The Law The cause of action for Hydroxycut injuries is usually a tort claim based in negligence, and the statute of limitations for suing someone in Texas for such an accident is two years from the date of injury. If you are experiencing symptoms of liver or other damage after having taken Hydroxycut, it is important that you first seek medical attention and then contact a lawyer as soon as possible so you can accurately determine your statute of limitations. Finding someone who knows how to handle large corporations, insurance companies and their lawyers, and what to address medically and legally will help to protect you from sure financial disaster and further potential medical problems. Money Damages Financial recovery can include present and future medical bills. Other potential areas of compensation, depending on the facts of the situation, are mental pain and suffering damages, lost past and future wages, permanent impairment/disfigurement, punitive damages, loss of enjoyment of life and wrongful death damages. Finding the right lawyer is the best way to secure a strong financial support base in order to get you through medical problems and resulting costs.
