Drugs and Medical Devices

"Value has been defined as the ability to command the price."
United States Supreme Court Justice Louis Dembitz Brandeis

St. Louis & Ohio RR v. US

Drug and Medical Devices Injuries

Pharmaceutical companies operate based on numbers. The more drugs they sell, the wealthier they get. Yes, they create many drugs and medical devices that help many people, but they also release drugs that do great harm. Drug companies' negligence is mainly based on their prematurely releasing drugs and medical devices without proper or enough prior research and development.

One assertion that has been made about the reason they do this is that the drug companies' true motivation is to release new pharmaceuticals in a hurry so that they are first on the market with the new drug; they are making a gamble on such a premature release, and are betting that they will generate enormous profits in the short run, over and above any damages they may have to pay in the long run due to any resulting personal injury litigation.

Whether pharmaceutical injuries happen due to greed or mere accident or negligence, many prescription drugs harm customers, sometimes irreparably. The expenses of such injuries can reach devastating proportions. In the April 2009 release of the Food & Drug Administration Adverse Events Reporting System, it was reported that in 2008, healthcare providers reported almost 270,000 adverse events and consumers reported almost 240,000 adverse events.

Although it may sometimes be difficult to know that you have been injured by a pharmaceutical drug until many years have passed, drug and medical device injuries must be addressed as soon as it is clear that an injury has occurred. When you or your loved one is injured, you must find the strongest legal counsel possible in order to do battle with the pharmaceutical industry. Chad Pinkerton is experienced in drug and medical devices personal injury and mass tort litigation and has the strength to address large companies and make them pay for their mistakes.

The Law
The cause of action is usually one based in negligence, and the statute of limitations is two years after the date of accident or injury. The difficulty with this statute of limitations is that sometimes it is almost impossible to know when a cause of action accrues because of the delayed problems and/or long-term effects that can occur when taking defective medicines. If you feel your statute of limitations may have passed, please contact an attorney quickly to discuss the situation.

Money Damages
Financial recovery can include past, present and future medical bills. Other potential areas of compensation, depending on the facts of the situation, are mental pain and suffering damages, lost past and future wages, permanent impairment/disfigurement, punitive damages, wrongful death damages and loss of enjoyment of life.

Finding the right lawyer to protect your rights and address the wrong that has occurred in your life is a critical step.
